Procedural costs and administrative charges for the basic traffic procedure
Promotional loan for condominiums and homes - takeover by the purchaser:
In addition to the ongoing repayment rate, extraordinary repayments of up to 50% of the outstanding capital or shortening the term are possible. The purchaser is not legally entitled to a promotional loan.
Any neighboring services according to the municipality's prescription such as development costs and building site construction costs as well as connection fees and costs for e.g. Electricity, gas, water, sewer, telephone etc.

Incidental costs for rental contracts


Fee for the rental contract (§ 33 TP 5 GebG):
1% of the gross rental interest (including VAT) for the duration of the contract, up to 18 times the annual value,
in the case of an indefinite contract duration 1% of three times the annual value.

Since 1.7.1999, the property owner (or, on his behalf, the broker, property manager, lawyer or notary) has been obliged to calculate and pay the fee himself. In the case of fixed-term contracts for buildings or parts of buildings that serve predominantly residential purposes, the fees are limited to three times the annual value from this point in time.

Contract establishment costs by agreement within the framework of the tariff regulations of the respective document issuer.

Agency fee:
The gross rent is used to calculate the commission. It consists of:
- main or sub-rent,
- pro rata operating costs and current public charges,
- share for any special expenses (e.g. lift),
- Any remuneration for furnishings and equipment that are also rented
or other additional services provided by the lessor.

For the calculation of the commission basis the sales tax is not to be included in the gross rent. The heating costs are also not to be taken into account if it is a matter of arranging tenancies for an apartment in which the amount of the rent may not be freely agreed in accordance with the tenancy law provisions (appropriate rent, guideline rent).

A commission for special payments of up to 5% can also be agreed with the previous tenant.

Fee for the lease agreement (§ 33 TP 5 GebGes):
1% of the gross rent on the contract;
in the case of an indefinite contract duration 1% of three times the annual gross rent.

a) Leases, especially in agriculture and forestry

For the brokerage of the lease of real estate or parts of real estate, a commission may be agreed with both clients, which is fixed at a percentage of the lease rate due on the lease term.

For the mediation of compensation for investments or furnishings, 5% of the amount paid by the lessee may be agreed with the lessor or previous tenant.


Incidental costs in the mediation of building rights

When brokering building rights, the maximum commission is for a duration of the building right of

With a building lease term of more than 30 years, instead of the 2%, a lump-sum commission of 3% plus VAT calculated from the building interest may be agreed for 30 years (value limit regulation § 12 Para. 4 IMVO). As the upper limit is limited to 2% of the building interest due for 45 years, this amount represents the maximum commission regardless of a longer contract term. 3%
